1.1. Strictly Educational & Statistical Purpose: KPITradeX is a Software-as-a-Service (SaaS) technological platform designed exclusively for trade journaling, retrospective quantitative analysis, telemetry, and graphical performance metrics visualization.
1.2. No Financial Advisory or Consulting: KPITradeX, its developers, and automated tools (including Artificial Intelligence or Copilot modules) DO NOT act as financial advisors, do not provide securities consulting, do not issue buy/sell recommendations, do not manage client portfolios, and do not provide brokerage services.
1.3. AI & Assistant Output Interpretation: Any commentary, diagnostics, statistical summaries, or interactions generated by AI features are automated algorithmic computations intended solely for self-reflection and reference. Under no circumstances do they constitute operational trading recommendations or guarantees of profitability.
1.4. Brand Independence: MetaTrader 5 (MT5) is a registered trademark of MetaQuotes Software Corp. KPITradeX is an independent product and maintains no corporate partnership, endorsement, or affiliation with MetaQuotes, nor with any specific proprietary trading firm (Prop Firm) or broker.
2. Market Risk & Operational Disclaimer
2.1. Comprehensive Financial Risk: Trading financial derivatives, foreign exchange (Forex), futures, equities, and digital assets carries a significant risk of financial loss. Users acknowledge and accept that they may lose up to the entirety of funds deposited with their financial intermediaries.
2.2. Autonomous Decision-Making: Users bear sole responsibility for evaluating and executing trades. Historical computations, profit factors, recovery metrics, and visual telemetry represent past data that do not guarantee future performance.
2.3. Prop Firm Evaluation Accounts Disclaimer: KPITradeX is not liable for account losses, rule breaches, disqualifications, or suspensions in proprietary trading challenges or broker accounts. Daily loss thresholds and maximum drawdown indicators calculated by the software are mathematical approximations and do not replace direct monitoring via your broker's trading terminal.
3. Non-Custodial Architecture & Connectivity
3.1. Absence of Custody: KPITradeX does not hold, custody, or manage user funds or financial assets. The Platform exclusively processes read-only operational telemetry transmitted via file reports or data protocols.
3.2. Exclusive Read-Only Credentials: Users agree never to provide master trading or withdrawal passwords. Account integrations must strictly utilize read-only investor passwords or authorized Expert Advisor (EA) synchronization tokens.
4. Payments, Billing & Merchant of Record
4.1. Merchant of Record & Billing Processor: All digital transactions, subscriptions, payment processing, and billing compliance are handled by our authorized reseller and official Merchant of Record: Lemon Squeezy, LLC (a Stripe company).
4.2. Billing Relationship: When purchasing a paid tier, users enter into a direct commercial billing relationship with Lemon Squeezy, LLC, who acts as the authorized reseller (Merchant of Record) and assumes responsibility for tax compliance, statutory obligations, and payment processing. KPITradeX does not collect, process, store, or have access to credit/debit card numbers or private user banking credentials.
4.3. Cancellations & Automatic Renewals: Subscriptions renew automatically on a recurring monthly or annual basis. Users may cancel automatic renewals at any time via their account settings or using the link provided in Lemon Squeezy billing receipts.
4.4. Refund Policy: As a digital software service with immediate and continuous access to analytics, payments are non-refundable once a billing cycle begins, except where required by mandatory consumer law or specific trial offers announced at checkout.
5. Technical Availability, Outages & 'AS IS' Warranty
5.1. Provided 'AS IS': The Platform and auxiliary tools are provided on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, express or implied. Continuous, error-free, or uninterrupted operation is not guaranteed.
5.2. Network & Third-Party Outages: KPITradeX and its developers disclaim liability for connectivity failures or delays via WebRequest or MT5 servers; cloud infrastructure outages (Cloudflare, Supabase, VPS, or hosting providers); and temporary discrepancies resulting from third-party API changes or software updates.
6. Absolute Limitation of Liability (Damage Cap)
To the maximum extent permitted by applicable law:
6.1. KPITradeX, its developers, and contributors shall not be liable under any legal theory (contract, tort, or negligence) for direct, indirect, special, punitive, or consequential damages, including loss of profits, trading capital, commercial downtime, or account suspensions arising from the use or inability to use the software.
6.2. In the extraordinary event that liability is determined by a competent court, the total aggregate liability of KPITradeX shall be strictly capped at the amount actually paid by the user to the Platform during the three (3) months immediately preceding the incident, or fifty US dollars ($50 USD), whichever is lower.
7. Intellectual Property Rights
All rights, titles, and interests in the KPITradeX codebase, proprietary algorithms, visual design, brand assets, and analytical telemetry methodologies belong exclusively to KPITradeX. Unauthorized copying, decompiling, reverse engineering, or automated scraping is strictly prohibited.
8. Customer Support & Dispute Resolution
8.1. KPITradeX operates 100% digitally. In-person and phone support are not provided.
8.2. Exclusive official support and compliance channels:

8.3. In the event of any disagreement or dispute, users agree to notify customer support in writing and allow a mandatory good-faith resolution period of at least thirty (30) days prior to initiating formal arbitration or legal proceedings.
